1. GENERAL INFORMATION AND SELLER DATA

1.1 These General Terms govern the remote sales of the products, marked by Mia’s, on the website www.miasitaly.com, by Mia’s Srl Unipersonal based in Alessandria (AL), via Lelio Basso, 12/A, registered on the Alessandria Register of Companies at AI-252243, VAT identification number 0239798067. 1.2 These Terms are governed by Legislative Decree 206/2005 (consumer code) as well as integrated and amended by D.Lgs No.21/2014 and legislative Decree No.70/2003 (e.commerce code).

2. CUSTOMER REQUIREMENTS

2.1 Recipients of the service are only those who have the following requirements:

– Being a consumer under the senses and effects of D.Lgs 206/2005 as individuals who purchase products on www.miasitaly.com with purposes not related to commercial, business or professional activity.

– Being of legal age.

– Having a valid email address.

2.2 As a result of the above, Mia’s retains the right not to fulfil orders from customers who do not meet these requirements. Also, orders for non-enabled countries cannot be fulfilled.

2.2 Due to the above, MIA’S reserves the right not to process orders from customers without the above requirements. Furthermore, orders destined for non-authorized countries cannot be processed.

 

3. PRODUCT INFORMATION

3.1 The main features of the products sold online are illustrated in the data sheet on the Website and can be viewed before proceeding with the purchase of each product. A further descriptive summary of the main characteristics is also provided next to the image of each product displayed. Mia’s Unipersonal Srl retains the right to modify the product descriptions at any time. The images published on the Site represent, as faithfully as possibile, the products offered for sale. However, the colours of the products and/or the size of the products may differ from the actual ones due to the browser or monitor used when browsing the site. Mia’s will therefore not be responsible for the possible inadequacy of the images or colours of the products depending on technical causes.

For the purposes of the purchase agreement, only the description of the product provided in in the data sheet on the site will be valid.

 

4. PRICES

4.1 The prices of the products are expressed in euros, including VAT, and do not include any shipping costs, if due. Chargeable shipping costs are indicated when the customer makes the order.

The price of the products on sale may be different for different countries and it is expressed in local currency.

4.2 MIA’s Srl Unipersonale retains the right to change the price of a product at any time and without notice, as long as the price charged to the customer will be the price indicated on the site at the time of placing the order.

 

5. PURCHASING MODE, PAYMENT MODE AND BEGINNING OF THE CONTRACT

5.1 To purchase one or more products, the customer must carefully fill in and transmit to MIA’s via telematics a Purchase Order (which applies as a contract proposal) that summarises information about the essential characteristics of each ordered product and its price, means of payment, delivery methods, and shipping costs. Before submitting the order, the customer can verify the entered data and correct any mistakes. When the order is completed and before it is forwarded, the customer will be asked to confirm the reading and acceptance of the General Terms of Sale, without which it is not possible to refine the order.

5.2 The Purchase Order will be stored in our database for the period of time necessary to process orders as well as for administrative purposes (and in any case within the legal terms).

5.3 Only the following methods will be accepted for the payment of orders:

a) Credit Card – The credit cards accepted are those belonging to the Visa, MasterCard, American Express circuits.

b) Paypal – Choose this payment method to pay through your PayPal account or credit card. We retain the right tho ship the products to the address listed on the account verified by PayPal. For more information click here.

c) Amazon Pay

d) Apple Pay

e) Bank transfer – after placing the order you will receive an email with the amount to be paid and the bank details on which to make the transfer to MIA’s Srl Unipersonale. The purchased products will be shipped only after the payment is received on the bank account.

In any case, there will be no charges for the use of the above means of payment, that is, rates that exceed those incurred by the company.

5.4 Upon receipt of your purchase order, Mia’s will automatically send you an e-mail confirming receipt of the order and taking charge of it, which does not constitute acceptance of the order.

The Contract shall be considered concluded when the Customer receives confirmation from MIA’s, via a second e-mail at the indicated address, that the Purchase Order, following the verification of the correctness of the data and the availability of the Product, has been successful and has therefore been accepted.

The acceptance email will contain a deferral to these pre-accepted Sales Terms and a full summary of the purchase made.

MIA’s may not process Purchase Orders: (a) that are incomplete or incorrect, or (b) in case of unavailability of the Products (if they are no longer available for sale); (c) if the credit card information entered is not correct and/or permission has not been received to charge that credit card. In such cases, we will promptly inform you by e-mail that the contract is not concluded, specifying the reasons for it and providing for any necessary refunds.

5.5 the credit card information entered will be treated with the utmost confidentiality. Mia’s is not responsible for any fraudulent use of credit cards by individuals other than the holder. In any case, for additional security, Mia’s retains the right to cancel the transaction and/or to request additional information or documents in case of suspected fraudulent use of the credit card.

 

6. ORDER FULFILLMENT AND SHIPPING

6.1 All orders placed on the website are shipped from Mia’s, Alessandria, Italy, Monday to Friday between 2pm and 5.30pm. Orders placed on weekends and public holidays will be processed from the following business day.

6.2 Orders for items already available in stock will be shipped within 3 business days from the time of the order; whereas for items that are temporarily out of stock, shipping is guaranteed within 3 weeks and in any case within a maximum period of 30 days from the date of conclusion of the contract. At certain times of the year, any delays in delivery may occur due to organisational reasons or shortage of staff; such changes will still be reported through an email communication. In case of failure to comply with the maximum delivery period of 30 days, the customer must forward to the customer service the invitation to make the delivery within an additional period appropriate to the circumstances. If the additional period thus granted expires without the goods being delivered to him, the customer is entitled to terminate the contract.

6.3 Shipments are made by DHL or TNT Courier, standard shipping. At the time of shipping the customer receives a second order confirmation, by email or sms, with the communication of the tracking number useful for the purpose of tracking the shipment at any time.

6.4 The shipment is made to the address indicated in the “shipping address” field on the purchase order.

6.5 MIA’s Srl Unipersonale ships to Italy, San Marino, Germany, Sweden, Norway, Denmark, Belgium, Netherlands, Luxembourg, Brazil, China, Venezuela, Finland, Estonia, Latvia, Lithuania, Spain, Portugal, Gibraltar, Andorra, Slovenia, Slovakia, the Czech Republic, Hungary, France, Iceland, Greece, Cyprus, the United States, Canada, Switzerland, Mexico, Ecuador, Uruguay, Colombia, Austria, Ireland, the United Kingdom, Malta, Romania, and Poland, Australia, and New Zealand. For other locations, you can write an email and ask for the possibility of shipping and its cost.

6.7 The customer must verify the items immediately at the time of delivery and then report any anomalies and/or tampering and/or damage directly to the courier on the delivery document and, later, to Mia’s at the email address: info@miasitaly.com.

 

7. REASONS OF FORCE MAJEURE

7.1 Mia’s Srl Unipersonale retains the right to postpone the shipment if events of force majeure occur.
MIA’s will therefore not be liable for the total or partial non-compliance of the obligations set in this contract, if such a default is caused by force majeure events, including, but not limited to, catastrophic natural events, acts of terrorism, wars, riots, lack of electricity, general strike of workers, strike and/or restrictions in theme of the viability of couriers and air links.

 

8. PRODUCT GUARANTEE

8.1 All products purchased on the website www.miasitaly.com are covered by a legal guarantee of conformity and manufacturing defects manifested within two years of delivery. The customer has the right to restore, without charge, the conformity of the goods by repair or replacement or, if such remedies fail, to a reduction of the price or conclusion of the contract. Any discrepancies, defects, faults and/or malfunctions caused by accidental events or by the customer’s responsibility or by a use of the product not in accordance with its intended use are excluded from the scope of the legal guarantee. All items sold on the site www.miasitaly.com must not come into contact with water, perfumes or other agents which may alter the product. In order to take advantage of the guarantee, the customer must provide evidence of the date of purchase by keeping the receipt of payment.

8.2 If you experience a defect of conformity on products purchased from MIA’s srl, during the legal guarantee period, please contact the customer service at info@miasitaly.com, including your personal data (first name, last name and address for the collection of the goods) and the order number. The company will arrange the collection of the goods at its own expense, as well as the new shipment.

 

9. RIGHT OF WITHDRAWAL 

9.1 Customer satisfaction is our main goal.

If for any reason the customer is not satisfied with his purchase, he will have the right to withdraw from this contract within 14 business days from receipt of the ordered products. In the case of multiple purchases -made with the same order- the deadline will start from the receipt of the last product.

The right of withdrawal is excluded in the case of custom-made or clearly customised products. To exercise the right of withdrawal, the customer is required to apply for product return authorisation with an explicit communication to the email address info@miasitaly.com. Mia’s will then immediately send a confirmation of receipt of the withdrawal by e-mail.

In order to comply with the withdrawal deadline, it is sufficient for the Customer to send the communication concerning the exercise of the right of withdrawal before the expiration of the withdrawal period (14 days after receipt of the ordered products).

As a result of the withdrawal, all payments made in our favour will be refunded to the customer, except for the delivery costs if due, without undue delay and in any case no later than 14 days from the day we are informed of the customer’s decision to withdraw from the contract. All refunds will be made using the same means of payment used by the Customer for the initial transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not have to bear any cost ad a result of that refund. In any case, the refund will be suspended until the receipt of the goods or until the customer has demonstrated that he has returned the goods.
The Customer is requested to send the Product back to the Customer Service WEB – MIA’s Srl Unipersonale, Via dell’orso, 12 – 20121 Milan – Italy without undue delay and within 7 days of the day he has received the communication containing the return authorisation number. The deadline is met if the Customer sends back the goods before the expiration of the period of 7 days. In view of the nature of the products, the customer must return the products through courier or insured post, so that he can be refunded in case of theft or loss.
The costs of returning the goods are borne by the customer.

The customer is only responsible for the decrease in the value of the goods resulting from a manipulation of these other than that necessary to establish the nature, characteristics and functioning of the goods. You will be contacted by Customer Service if your return does not conform to the conditions listed below in the following art. 9.2, as well as summarised in the Return Procedure. In this case, the customer can choose whether to accept the reduction of the refund that will be communicated, which is equal to the decrease in the value of the returned products, or to have back the products purchased at his own expense. If you refuse to receive the return of the product, Mia’s will hold the product and the amount indicated as a decrease in the value of the returned products.

9.2 Once the Return Procedure ha been activated, through the communications presented in the previous art. 9.1, the customer will receive a written confirmation from info@miasitaly.com, by email, containing the return authorization number. The document, which contains the return authorisation, must be printed and attached together with the item. In the absence of the authorization, Mia’s will not accept any returns.

9.3 It is clear that the returned item must comply with the following conditions: 1. it must not have been used, worn, washed. 2. the package must not show any signs of wear, abrasions and scratches. 3. the product must be accompanied by the attached guarantee and including all labels, packaging and original accessories.

9.4 Mia’s will not accept the returned goods if the return does not comply with all the terms and conditions of the return policy. In addition, please note that Mia’s will not accept the return in the following cases: a) in the event of theft or loss of the item during the return; b) if the item is returned used or in any way damaged.

 

10. PERSONAL DATA

10.1 For information on the methods and purposes with which your personal data is collected and used, please read carefully the Privacy Policy published on the site.

 

11. GOVERNING LAW AND JURISDICTION

11.1 The purchase agreement expressed on the website is governed by Italian law.

11.2 For the resolution of all disputes arising from the interpretation and / or execution of these general terms of sale and the purchase agreement, the Court of Milan is responsible.

11.3 For all disputes concerning this contract of sale or related to it, which may arise between the parties, an attempt at friendly conciliation may be promoted in accordance with the procedure of mediation, which can also be activated online, governed by the regulations of the Conciliation Service of the Chamber of Commerce of Milan, registered in the register of Conciliation Bodies held by the Ministry of Justice.

 

12. CONDITIONS 

12.1 Mia’s retains the right to modify and/or supplement these General Terms of Sale at any time. Any changes and/or additions will be effective from the date of publication of them on the website www.miasitaly.com.
